條例旨在為市民提供更多安全、合法合規的選擇,同時兼顧整體服務業的健康和有序發展,締造良性競爭環境。
立法規管預製菜
近年不少食肆為了提升效率及降低營運成本,向外採購或自行生產以供顧客享用。有意見指出,為保障消費者權益,設立法例監管製作、運輸和銷售預製菜。本局會視乎該建議之可行性及效用而認真考慮該建議。
首先,所有本港出售的食物均受嚴格規管,食環署監控食物安全及環境衞生,食物安全中心抽檢進口、批發及零售食品。
其次,規管有利政府形象。政府以身作則,主動保障食物安全及市民健康,可改善政府形象。正面的政府印象會令施政更容易得到支持。
第三,規管長遠而言可減少政府開支或負擔。本地食物安全提升,長遠而言可以減少市民健康隱患,從而減少公眾醫療開支。除了醫護人員的支出,亦有可能減輕醫院床位需求。
然而,規管不利本地經濟,減少國民生產總值。從食物安全的角度來說,食物安全與預製菜沒有關係,強制食肆作出標示並不會進一步改善食物安全,只會增加其營運成本。
再者,此舉可能引起社會矛盾,減少社會凝聚力。預製菜是一個比較新的詞語,無劃一的定義,業界與消費者都有不同理解和期望。硬性規定不但難以執行,也容易引發食肆和消費者的爭拗。
縱觀以上所述的利弊存在矛盾,然而食物安全是公眾關心的議題,涉及市民健康。為了保障消費者權益,本局見到食物安全的重要性。以下是本局的建議,為求確保方案可有效達至其政策目的。
第一,本局就措施進行公眾諮詢,在規管預製菜時顧及民意,聽取各持份者的意見,包括食肆和製作商,亦會開放接受大眾對規管的意見。
第二,本局會參考海外地區的成功經驗,再作研究。內地並非強制性,而是鼓勵性質,不具約束力。
第三,食物安全由教育開始。除了立法規管,本局亦期望透過公民教育,如學校巡迴講座,加強社會對食物安全的意議。
考慮到執行困難,加上本港經濟低谷,本局建議採用非立法措施,如設立自願監管制度,讓業界逐步按新措施改善營運模式,以符合市民的理解和期望。

Many restaurant have purchased premade dishes from external sources or produced them in-house to enhance efficiency and reduce operating costs. It has suggested government to offer legislation governing the production, transportation and sale of premade dishes, and protecting the relevant consumer rights.
First and foremost, food safety legislation is existing. Local food factories must obtain a food factory licence from the Food and Environment Hygiene Department under the Food Business Regulation. The Centre for Food Safety collects food samples for testing at import, wholesale and retail levels under risk-based principle on an ongoing basis.
Consequently, it will elevate the government status from community.

However, there are a number of issues that engender the public concerns.
To begin with, the overseas investment may be discouraged.
Accordingly, the regulation would bring the conflict between citizens and producers. It not only would present enforcement challenges, but also potentially give rise to disagreements between restaurants and consumers.

Firstly, the government will conduct the public consultation to gauge the relevant views and opinions from all stakeholders.
Secondly, timely reviews will be conducted on a yearly basis to closely monitor whether the regulation should be reintroduced. In case the problem of premade dishes cannot be curbed.
Furthermore, the government would also step up publicity by educating the public on appropriate cooking of premade dishes.
